THESE WRIT PETITIONS COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER Petitioners herein are before this Court seeking a writ of mandamus in directing the respondent – Deputy Commissioner to consider their representations dated 8.4.2002, 12.2.2017 and 19.12.2017.
2. Heard the learned counsel for the petitioners and the learned Additional Government Advocate. Perused the material on record. On going through the same, it is seen that the petitioners herein are before this Court pursuant to the order dated 4.3.1994 in Appeal Nos.136/1986 and 130/1991 on the file of Karnataka Appellate Tribunal at Bengaluru vide Annexure-A, wherein the Tribunal allowed the said appeals and remanded the matter back to the Deputy Commissioner with a direction to him to consider the case of the appellant therein afresh after giving sufficient opportunity to the parties concerned. It is pursuant to such liberty, the legal representatives of original applicant before the Tribunal made the aforesaid representations, which are not considered till today.
3. In that view of the matter, the Deputy Commissioner is directed to consider the representations of the petitioners herein in accordance with law within a period of three months from the date of receipt of a copy of this Court.
Accordingly, these writ petitions are disposed of.
Learned Additional Government Advocate is permitted to file memo of appearance within Sd/- JUDGE nd/-
