JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) 1.0 Learned senior advocate Mr. Kavina appears with learned advocate Ms. Mamta R. Vyas for the appellants. The learned senior advocate places on record an unaffirmed affidavit on behalf of the appellant. The learned senior advocate submitted that the same could not be affirmed as the appellant - Managing Trustee is hospitalised. He has given the unaffirmed copy to the Party in Person and the same is filed saying that the same will be affirmed by the Managing Trustee as soon as he is available for affirming the same.
2.0 The learned senior advocate also states that order passed by this Court on 18th January 2012 is under challenge before the Honourable the Apex Court by filing Special Leave Petition being No. 5368 of 2012. The learned senior advocate further states that he is trying to see that the said Special Leave Petition is taken up for hearing at the earliest, may be by tomorrow. At his request, the matter is kept tomorrow i.e. 10th February 2012.
