1. This application has been preferred u/s.24 of the Code of Civil Procedure seeking transfer of the proceedings of H.M.P. No.198/2011 pending before the Court of learned 4th Principal Sr. Civil Judge, Nadiad to the competent Court at Anand.
2. The facts in brief are that the marriage between the applicant and respondent was solemnized in the year 1985. On account of certain disputes between them, proceedings u/s.13 of the Hindu Marriage Act were initiated by the applicant and they are pending before the concerned Court at Anand. The respondent had filed application u/s.9 of the said Act before the concerned Court at Nadiad, which is reported to be pending. By this application, the applicant has prayed to transfer the proceedings filed u/s.9 of the said Act by the respondent to the competent Court at Anand.
3. Heard learned counsel for the applicant. The applicant has not made out any specific ground for transfer of the proceedings to the Court at Anand. The applicant has two children, who are adult. The distance between the two places cannot be said to be far. In view of the same, I do not find any reasons to tranfer the proceedings from the Court at Nadiad to the competent Court at Anand. Consequently, the application stands rejected.
