JUDGMENT / ORDER

1. By way of this petition under Article 226 of the Constitution of India, the petitioners have inter alia challenged order dated 20.10.2011 passed by the Secretary, Revenue Department, Ahmedabad in Revision Application No.MVV/HKP/RJT/100/2011.
2. Heard Mr.Majmudar, learned counsel appearing for the petitioners and Ms.Asmita Patel, learned A.G.P. appearing for respondent Nos.9 to 11.
3. Considering the fact that the present petition is filed against the interim order dated 20.10.2011 whereby, application for stay filed by the petitioners was not entertained, Mr.Majmudar, learned counsel does not press this petition at this stage.
4. Mr.Majmudar, learned counsel however, states that the petitioners be permitted to file an application for expediting the hearing of Revision Application No.MVV/HKP/RJT/100/2011.
5. In view of the above, if any such application is filed by the petitioners, the Secretary, Revenue Department, Ahmedabad shall decide the same within a period of four weeks from the date of receipt of copy of this order and fix the main Revision Application No.MVV/HKP/RJT/100/2011 for hearing as early as possible.
6. It is however, made clear that Secretary, Revenue Department, Ahmedabad shall decide the main revision application on its own merits without being influenced by the fact that the present petition is not pressed and also without being influenced by order dated 20.10.2011 wherein, the observations made are only of prima facie stage.
7. With the above observations, the petition stands disposed of as not pressed. No order as to costs.
