By order dated 06.09.2012, the Court issued fresh notice to Respondent No.2, who is having address in the State of Uttar Pradesh requiring it to be served through SSP, Etawa, Uttar Pradesh. Notice is not getting served, in wake of the grievance raised by the applicant vide affidavit dated 08.11.2012, alleging that the concerned Respondent is somehow and anyhow avoiding the service of notice.
On the last occasion i.e. on 26.11.2012, Learned APP was required to find out the mechanism on the basis of which the notice to Respondent NO.2 can be duly effected. Learned APP, MR.L.R.Pujari states that he will instruct the authority concerned of Naroda Police Station to see to it that service of notice of this Court is effected through medium of Naroda Police Station on Respondent No.2 on the address of U.P., mentioned in the cause title of Criminal Revision Application, which is according to learned Advocate for the Applicant Mr.N.L.Ramnani is correct.
Fresh notice to Respondent No.2, returnable on 9th January, 2013.
Learned APP Mr.L.R.Pujari is directed to instruct the concerned Police Station to undertake necessary process and steps to effect the service.
For the above purpose, learned Advocate Mr.N.L.Ramnani seeks to join the Police Inspector, Naroda Police Station as party Respondent. Permission, as prayed for, is granted. Leave to amend.
