ORDER:
Heard the learned Counsel for the petitioner and learned Standing Counsel for the first respondent.
This Writ Petition was filed challenging the action of respondents in threatening to take coercive steps for removal of the boards erected by the petitioner-Company at its business place, shops etc., without giving opportunity and action of the first respondent in authorizing the second respondent to exercise the statutory powers contrary to the provisions of the Hyderabad Municipal Corporation Act, 1955.
The learned Counsel for the petitioner submits that the issue raised in the Writ Petition is squarely covered by the decision of this Court in Kasturi Brothers, Dress Materials and Saree Shop, Hyderabad, Vs. Municipal Corporation of Hyderabad {2007 (1) ALD 481}. The same is not disputed by the learned Standing Counsel for the first respondent.
In the circumstances, following the ratio laid down in the aforesaid decision, the present Writ Petition is allowed in terms thereof.
Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
