Heard learned counsel for the petitioner, learned A.G.A. appearing for the State and perused the impugned F.I.R. as well as material brought on record.
This writ petition has been filed by the petitioner to issue a writ, order or direction in the nature of mandamus commanding or directing respondent no. 2 to conduct fair investigation by independent authority in NCR No. 9197/2016 u/ss. 406, 498, 392, 411 IPC, PS. Kerakat, District Jaunpur.
Learned counsel for the petitioner submits that the petitioner is the informant of the case and an NCR was lodged by him against respondent no.4 and though the Magistrate has ordered for investigation u/s. 155 (2) CrP.C but the same has not been concluded.
As the matter is pending investigation, we are not inclined to interfere with the same.
However, it is open for the petitioner to approach the Magistrate concerned for appropriate orders.
The writ petition is, accordingly, disposed of.
