Heard learned counsel for the petitioner.
The instant petition under Article 227 of the Constitution of India challenges judgment and decree dated 15.01.2018 passed by Civil Judge (Jr. Div.), Jaunpur in Original Suit No. 938 of 2014.
It is well settled that against an ex parte judgment and decree, the party aggrieved could either file an appeal under Section 96 of the C.P.C. or an application under Order 9 Rule 13 C.P.C.
Under the circumstances, this petition under Article 227 of the Constitution of India is misconceived and is dismissed accordingly.
