Heard Mr.R.C.Kakkad, learned advocate for the applicant. He has submitted that during the hearing of Ex.11 application in Sessions Case No.57 of 2008 on 28.7.2010 learned Judge has passed order, fixing for hearing. On 19.3.2011, the application is allowed by the learned Judge. Mr.Kakkad submitted that present petitioner is never heard by the learned Judge.
For the purpose of deciding this issue record and proceedings is required to be called for to persue rojkam, whether on the date of hearing of Ex.11 application between 28.7.2010 and when application is disposed of on 19.3.2011 the present petitioner was present or not.
Office is directed to call for record and proceedings from the trial Court so as to reach this Court on or before 12.4.2012. S.O. to 17.4.2012.
