Heard learned advocate for the applicant and it is submitted that with regard to the disputed entry and entering the name in the revenue record, a private complaint came to be dismissed by learned Judicial Magistrate First Class, Mandvi, Kachchh, in exercise of powers under Section 203 of Code of Criminal Procedure, 1973 on 27.12.2011. Besides, proceedings by way of appeal is pending before the Dy. Collector, Mundra, Kachchh, preferred under Rule 108 of the Land Revenue Rules. In the above circumstances, it is prayed that complaint impugned be quashed and set aside and stay till final disposal.
Considering the above aspects, the investigation pursuant to the impugned complaint shall remain stayed till the appeal preferred before the Dy. Collector, Mundra, Kachchh, with regard to subject matter is finally decided.
