Bharatkumar vs State

High Court Of Gujarat|19 June, 2012

JUDGMENT / ORDER

1. This petition has been preferred seeking a direction to the respondents to grant appointment to the petitioner on compassionate grounds.
2. The father of the petitioner, Shivramji S. Thakor, passed away on 06.10.2006 while in service with the respondent-Panchayat. Pursuant to his death, the petitioner made application dated 16.10.2006 seeking appointment on compassionate grounds. However, his application was rejected. Being aggrieved by the same, the present petition has been preferred.
3. Heard learned counsel for the parties. The order rejecting the application of the petitioner seeking compassionate appointment was passed on 24.09.2008. No satisfactory explanation has been given by the petitioner for the delay of more than three years caused in filing the present petition. In the case of Shiv Dass v. Union of India & Ors., AIR 2007 SC 1330, the Apex Court has held that if petition is filed beyond a reasonable period, say three years, normally, the Court would reject the same or restrict the relief.
4. Considering the facts of the case and the principle rendered in the above decision, I do not find any merits in this petition. Hence, the petition, being devoid of merits, is rejected summarily.
