JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) The present application is being considered qua applicant no. 1-convict Bharatji Pratapji Thakor and learned counsel for the applicants does not press this application qua applicant no. 2-convict Balvantji Pratapji Thakor.
By way of this application, the applicant-father has prayed that applicant no. 1-convict Bharatji Pratapji Thakor be enlarged on temporary bail to attend the marriage of his cousin. Pursuant to the earlier order passed by this court, Learned APP Mr. Pandya, based on the report submitted by the Kheralu Police Station, has submitted that the ground mentioned in the application is genuine. From the jail remarks, we find that on earlier occasion, when the applicant no. 1-convict was enlarged on temporary bail and furlough, he has surrendered in time.
3. Considering the totality of facts, the applicant no. 1-convict- Bharatji Pratapji Thakor is directed to be enlarged on temporary bail for a period of one week from the date of his actual release on personal bonds of Rs. 5000/- with one surety of like amount with further condition that the applicant no. 1-convict shall surrender before the jail authority on expiry of the period granted by the Court.
4. The application is allowed to the aforesaid extent qua applicant no.1. Rule is made absolute qua applicant no. 1 and Rule is discharged qua applicant no. 2. DS Permitted today.
