Bharatiben vs Pratik

High Court Of Gujarat|03 July, 2012

JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE A.L.DAVE) The corpus is before us. The corpus states that she and respondent No.1 have informally married though not legally being minor. Her relationship with respondent No.1 was known to her parents which was not objected to for a period of about three years. The corpus states that she had to left her parents' house and respondent No.1 had accompanied her and their relationship was opposed by her parents. She does not want to go and stay with the petitioner as she feels insecure.
The corpus is aged 17 years and 1 month. She appears to us to be quite matured, physically and mentally. However, being a minor, the petitioner would be her legal guardian, but, since the corpus does not want to go and stay with them, we direct the corpus to be admitted to Sisu Mangal at Junagadh till she attains majority. Thereafter she would be free to go to the place of her choice. The Sisu Mangal authorities will permit the visitors to meet the corpus only if the corpus so desires. The petition stands dismissed accordingly. Notice discharged.
