Heard learned counsel for the petitioner as well as Dr. Y. Padmavathi, learned standing counsel for Municipal Corporation appearing for the respondents 1 and 2.
The petitioner alleges that he made a complaint to the respondents 1 to 3 against the fourth respondent for making unauthorized constructions and the petitioner also gave a legal notice to the said respondents prior to filing of the present writ petition which is produced as Annexure-1, dated 17.5.2014 and it was served on them, but no action was taken. Alleging inaction on the part of the said respondents, the present writ petition is filed.
The learned standing counsel appearing for the respondents 1 and 2 submits that an appropriate action has already been initiated by the second respondent against the fourth respondent by issuing a notice under Sections 452 (1) and 461 (1) of the Greater Hyderabad Municipal Corporation Act, 1955 with regard to the deviations found in the constructions and further action will be taken in accordance with law after receiving explanation from the fourth respondent.
In view of the appropriate action already taken by the second respondent in accordance with the provisions of the Hyderabad Municipal Corporation Act, 1955, no further orders are necessary in this writ petition which is accordingly disposed of directing the second respondent to take appropriate action in accordance with law after notice and hearing the affected party. Miscellaneous applications, if any, shall stand closed. No order as to costs.
