Petitioner, Bharathiya Pattikajana Samajam, Reg. No. 5353/2002, has approached for assignment of a land in favour of the petitioner, situated in Sy. No. 18/4 of Aluva West Village for the purpose of using it as a burial ground. By Ext. P7, the District Collector, Ernakulam, forwarded the said application to the Government for a decision.
2. It is stated that the application submitted by the petitioner earlier, has been objected . It is pointed out that the property referred as above is a road purambokku and it is also against the Rules of assignment of land owned by the Municipality/Corporation. However, the District Collector has WP(C).No. 27322/14 2 placed the matter before the Government for a decision. Now, the matter is pending consideration before the first respondent/Home Secretary .
3. Accordingly, there will be a direction to the first respondent/Home Secretary to take decision on the application submitted by the petitioner within a period of two months after affording an opportunity of being heard to the petitioner.
The Writ Petition is disposed of as above.
