1. By way of this petition, the petitioner workman has challenged the judgment and order dated 04.11.2011, passed by the Presiding Officer, Labour Court, Junagadh, in Reference (LCM) No. 116 of 2005, whereby the Reference Court has rejected the said Reference with cost.
2. The brief facts leading to filing of this petition are that petitioner workman was working as permanent employee under the respondent-Board. On 31.12.2004 the services of the petitioner was terminated by the respondent. Therefore, the petitioner raised Industrial dispute which was registered as Reference (LCJ) No.116 of 2005. The Reference Court after hearing learned advocates for both the parties and after recording the evidence has rejected the said Reference vide judgement and order dated 4.11.2011, against which the present petition is filed by the petitioner-workman.
3. Learned counsel for the petitioner contended that the Reference Court erred in passing the impugned judgment and order. The Reference Court failed to appreciate the material on record in its true perspective. Therefore, he has prayed to allow the present petition.
4. Heard learned counsel for the parties and perused the material on record. I have gone through the impugned and order of the Reference Court and I find that the Reference Court after considering the evidence on record has passed the impugned judgement and order. I am in complete agreement with the reasonings given by and the conclusion arrived at by the Reference Court and hence, I find no reasons to entertain the present petition.
5. In the result, this appeal is dismissed. No order as to costs.
