Dattani, learned advocate and Mr. Majmudar, learned advocate have jointly submitted that the dispute involved in the impugned FIR and in present petition is private dispute and the petitioner and respondent no.2 have, after deliberation, settled the dispute. It is also submitted that actually in another cognate matter being Special Criminal Application No.3178 of 2012, order dated 05.11.2012 has been passed by this Court (Coram: Hon ble Mr. Justice Rajesh H. Shukla) wherein the Hon ble Court has taken note of the settlement and accordingly the said petition being Special Criminal Application No.3178 of 2012 is allowed in terms of the said order dated 05.11.2012.
Having regard to the aforesaid submissions by the learned advocates, below mentioned order is passed.
