Learned advocate pointed out that non judicial stamp papers of Rs.50,600/- were purchased on 13th March, 2012 for the purpose of registration of sale deed. This affixing of stamp duty is indicative of the market price price of the property and the same could never be less than Rs.2 Lacs. Considering the provisions of Civil Court Act, 2005, he urged that the order impugned requires interference.

Issue notice to otherside, returnable on 12th July, 2012. Direct service is permitted.

Interim reliefs in terms of Para-5(c) is extended till the returnable date.
