Heard Shri Ankit Srivastava, learned counsel for the petitioner. Shri Manjive Shukla, learned Additional Chief Standing Counsel appearing for respondent nos.1, 2 and 5 prays for and is granted four weeks' time to file counter affidavit. The Petitioner, if so advised, may file rejoinder affidavit within two weeks thereafter. Issue notice to respondent nos.3 and 4 returnable at an early date. Steps within a week. Learned counsel for the petitioner has submitted that the impugned order has been passed without affording any opportunity of hearing to the petitioner. Prima facie, a case for interim relief is made out.
Until further orders of this Court the operation of the impugned recovery notice dated 15.4.2021 (Annexure 2 to the writ petition) and citation dated 27.9.2021 (Annexure 1 to the writ petition) shall remain stayed. List after expiry of the aforesaid period.
