JUDGMENT / ORDER

As ordered by this Court wife respondent no.2 Smt. Vaishali Somani as well as her husband Bharat Somani and their respective parents are personally present before this Court.
Reunion is impossible. Therefore, their marriage be annulled by this Court and divorce be granted and no rights and liabilities will accrue on anybody and nobody will file case against each other. Both the parties have also agreed that all pending proceedings be quashed and nobody will institute any other civil, criminal or revenue proceedings against each other. Both husband and the wife also agreed that in one vacation children will live with the father and in other vacation children will live with the mother. Whenever there is a vacation of the elder son, he will join the company of the mother and whenever there will be vacation of the younger son, he will join the company of the father. Both the parties were directed to file affidavits with such an averment.
List this case again for further hearing on 18th January 2010.
Parties need not be present on the next date, but they are directed to file their respective affidavits, as mentioned above on the next date.
Meanwhile, rejoinder affidavit, if any, may be filed by learned counsel for the applicants.
Interim order granted by this Court dated 6.10.009 is extended till the next date of listing.
It is made clear that affidavit of both the parties will specifically mentioned regarding all the pending matters between both the parties and the courts thereof.
