Heard learned counsel for the petitioner. Dr. H.N. Tripathi has appeared for respondent no. 2.
The petitioner by means of this writ petition wants that his representation dated 1.5.2019 addressed to the SSP/District Magistrate, Varanasi be directed to be decided within time bound period.
A perusal of the representation reveals that the petitioner is aggrieved by the use of electric appliances by the neighbours and contends that on account of use of said appliances there is vibration in the entire house and this nuisance should be removed.
The petitioner for the purpose of removal of nuisance may approach the civil court or to the local authority concerned. There is no provision for redressal of such a grievance by addressing representation either to the SSP or to the District Magistrate.
In view of the above, we are not inclined to exercise the discretionary jurisdiction.
The writ petition is dismissed with liberty to the petitioner to approach the appropriate forum.
