List has been revised but nobody is present on behalf of the petitioner. Sri Kripa Shanker Singh, learned counsel for the respondents is present.
The petitioner has preferred present petition with the prayer to set aside the order dated 11.1.2008 passed by Judge, Small Causes/Prescribed Authority, Allahabad in P.A. Case No.2 of 1999 (Mrs. Perin N Amrolia & others Vs. Ram Vishal Mishra & others (Annexure-7 to the instant petition) with further prayer to allow the application dated 8.1.2008 (Annexure-3 to the instant petition).
From perusal of the record, it appears that by efflux of time either the parties have lost their interest or matter has become infructuous.
In the circumstances, it is needless to keep pending this petition.
Accordingly, petition is dismissed with liberty to file application for recall of this order within two months in case matter still survives if such an application is filed it need not be accompanied by any affidavit.
