Heard learned counsel for the applicants, learned AGA for the State and perused the record.
Learned counsel for the applicants has made a statement at the bar that he does not want to press the prayers as contained in the prayer clause of the present application and he is ready to surrender/appear before the court below to seek his bail and as such, a direction be given to the court below to consider and decide his bail application as expeditiously as possible.
From the perusal of the record, it transpires that a complaint was filed against the applicant under Section 447, 452, 450 of the Companies Act and learned Magistrate considering the allegations made in the complaint and after making requisite enquiry under Sections 200 CrPC and 202 CrPC, has summoned the applicant to face trial under Sections 447, 452, 450 of the Companies Act vide order dated 22.07.2016.
Pursuant to the summoning order dated 22.07.2016, the applicant did not appear before the court below and as such, NBW dated 02.11.2017 was issued against him, which order has been challenged before this Court.
Pursuant to the NBW dated 02.11.2017, the applicant is ready to appear/surrender before the court below.
In view of the aforesaid facts and circumstances, in case the applicant Rajiv Garg appears before the court below and applies for bail, his bail application shall be considered and disposed of in accordance with law as expeditiously as possible.
With the aforesaid observations, this application under Section 482 CrPC stands disposed of.
