(PER : HONOURABLE MR.JUSTICE AKIL KURESHI) By allowing Civil Application No.4334/2012 by order dated 20.4.2012, this Court permitted the petitioner to amend the petition as prayed for in such application. By virtue of such amendment Union of India, came to be joined as additional respondent no.4. However, no notice of this proceeding has been issued to such newly added respondent. We also notice that the petitioner through such amendment has called in question vires of section 65(105)(2k) of Finance Act, 1994. Since vires of Central Act is under challenge, notice shall have to be issued to the learned Attorney General as well.
Under the circumstances, Registry to issue notice of admission of this petition on respondent no.4 as well as to learned Attorney General, making it returnable on 25.1.2013.
