Heard Sri A K Chaurasiya, learned counsel for the applicants and Sri Amit Sinha, learned AGA for the State.
This application under Section 482 Cr PC has been filed by the applicants, seeking quashment of Charge-sheet dated 19.6.2015 in Case Crime No.194/2015 under Sections 452, 323, 504, 506 of IPC, Police Station Naujheel, District Mathura and the cognizance order dated 02.11.2015 as well as entire proceedings of Case No.1834/IX/15 (State Vs. Bhanwar Singh & Others) pending before Additional Chief Judicial Magistrate- IV, Mathura.
Counsel for the applicants submits that applicant no.1 is father of the girl and applicant no.2 is her brother, whereas remaining applicants are her relatives. It has been argued that applicants have gone for a compromise in the house of the complainant, but unfortunately, a false report has been lodged. He submits that he is not pressing this application, on merit. However, purpose of filing this application would be served, if a direction is issued to the trial Court to consider and decide the bail application of the applicant on the same day or at least by the next date, so that the applicants may not suffer any further injury.
State counsel, however, submits that discretion be given to the trial Court to decide the bail application in accordance with law.
This application is accordingly, dismissed, as withdrawn.
Needless to state that in the eventuality of filing any bail application by the applicants, the competent Court shall decide the same strictly in accordance with law on the same day.
