Heard Sri Anil Kumar, learned counsel for petitioner, Sri M.K. Maurya, Advocate holding brief of Sri Nishant Mehrotra, learned counsel for respondent no. 2 and learned Standing counsel.
Petitioner in the present case has merely prayed for the following relief:-
"i) issue a writ, order or direction in the nature of certiorari quashing the impugned Respondent Vehicle Inventory List dated 15.10.2020 which has been issued by respondent no. 2 i.e. Tata Capital Financial Services Limited, Branch Office: 6th Floor, Halwasiya Commerce House, Habibullah Estate, 11 M.G. Marg, Hazratganj, Lucknow against the petitioner for recovery of remaining loan amount.
ii) issue a writ, order or direction in the nature of mandamus directing the respondent no. 2 i.e. Tata Capital Financial Services Limited, Branch Office: 6th Floor, Halwasiya Commerce House, Habibullah Estate, 11 M.G. Marg, Hazratganj, Lucknowto accept the loan amount from the petitioner in easy installments as fixed by this Hon'ble Court."
The relief sought in this writ petition against respondent no. 2, who is private party and is not discharging any public function. No relief has been prayed against respondent no. 1.
In view of the above, the writ petition is totally misconceived and is accordingly, dismissed.
