Counter affidavit filed on behalf of complainant, is taken on record.
Heard Sri Azizul Hasan, learned counsel for the applicant, Sri Amit Daga, learned counsel for the complainant and Sri Vikas Rana, learned A.G.A. for the State.
It has been contended by the learned counsel for the applicant that the applicant is wholly innocent and falsely implicated in the crime in question, however he did not commit any crime whatsoever. The applicant is in jail since 16.08.2017. It is further submitted that the applicant has no other reported criminal antecedents.
Learned counsel for the complainant as well as learned A.G.A. have vehemently opposed the prayer for bail and submitted that the applicant was working as a Manager (Accounts) in M/s 4A Securities Ltd. since last four years and he was looking after all the works related to purchase and sales of shares. Being the Manager he was fully acquainted and in control of all the data related to the shares of the clients of the complainant company. The accused Bhanu Ranjan was the custodian of the DEMAT slip book. The accused with mala fide intention forged the signatures of Mr. Arvind Kumar Srivastava on the DEMAT Slip and entered his own account number in the column of beneficiary details and succeeded in transferring the shares of worth Rs. 3,00,00,000/- approximately into his share trading account maintained by him at Ventura Securities Ltd. with client ID 10771762.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Bhanu Ranjan involved in Case Crime No. 108 of 2017 under Section 420, 406, 409, 467, 468, 471, 120B I.P.C. and Section 66, 66C, 66D of Information Technology Act, police station Sector-20 Noida, District Gautam Buddh Nagar.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within preferably a period of one year from the date of production of a certified copy of this order, if, there is no legal impediment.
