1. Heard Sri Ashok Khare, learned Senior Counsel assisted by Sri Namit Srivastava, learned counsel for petitioner, Sri Vivek Verma, learned counsel for respondent-University and learned Standing Counsel for State-respondent no.1.
2. The writ petition is directed against order dated 19.7.2007 whereby State Government has excluded name of petitioner from final seniority list of Office Superintendent (Accounts) on the ground that those were promoted on wrong basis as Office Superintendent, has to be expugned.
3. It is contended that subsequently by order dated 20.11.2004 promotion of petitioner was challenged and this order was set aside by this Court in Writ Petition No.7769 of 2005 wherein order dated 20.11.2004 has been set aside and as a result thereto change in seniority of petitioner cannot be sustained.
4. Learned counsel appearing for the State could not dispute the aforesaid fact.
5. Hence, we find no option but to allow this writ petition. Writ petition is allowed accordingly. The order dated 19.7.2007 is hereby set aside.
