The present petition is directed against the transfer order dated 19.05.2018 with the assertion that the officer who was posted as District Development Officer, Allahabad has already been transferred viee order dated 16.05.2018 and as such he could not pass the order of adjustment/transfer of the petitioner in another block.
The petitioner is working on the post of Senior Assistant in Block- Soraon and by means of the order impugned, he has been sent to Block-Saidabad. The transfer of the petitioner is within the district.
In so far as the submission of learned counsel for the petitioner with regard to transfer of the officer concerned, vide order dated 16.05.2018, it is noteworthy that the said order has been passed by the State Government. It has not been demonstrated by the petitioner that the said transfer order was served upon the officer concerned and he was relieved by the date i.e. 19.05.2018, when the order impugned was passed.
All other allegations made in the writ petition relating the transfer being made on the complaint of the Gram Pradhan are baseless. The petitioner is holding a transferable post. The transfer is an exigency of service.
This Court is not supposed to ordinarily interfere in the transfer order except in a demonstrated case of malafide or violation of statutory rules. No such case is made out.
Dismissed as such.
