There is a suit for injunction pending between the parties being suit No.157 of 2017 filed by the plaintiff petitioner. During the pendency of the suit the defendant respondent is alleged to have disposed of the property which is subject matter of the dispute and therefore a direction has been sought from the District Magistrate to interfere and protect the subject matter.
Once a dispute is pending before the civil court, the District Magistrate has no power to interfere. Even otherwise, the executive authorities have no power to interfere in private dispute with regard to title. No relief can be granted as prayed for in this writ petition. The writ petition is dismissed.
