Heard learned counsel for the petitioner and Sri Baleshwar Chaturvedi, learned counsel appearing for the respondents.
The petitioner was provisionally assessed for unauthorized use of electricity. In the earlier round of litigation, the order rejecting the objections was set-aside as no opportunity of hearing was given to the petitioner and the Executive Engineer was directed to pass a fresh order.
Now, by the impugned order again an order has been passed on 18.6.2019 rejecting the objections of the petitioner preferred against the provisional assessment meaning thereby that the provisional assessment has became final. The petitioner is aggrieved by the same.
The petitioner has a remedy of filing appeal under Section 127 of the Electricity Act 2003 against the aforesaid order confirming the assessment as final.
In view of the alternative remedy so available to the petitioner, we do not deem it necessary to exercise our extraordinary jurisdiction. The writ petition is dismissed.
