Heard Sri Satish Mandhyan, learned counsel for the petitioner and Sri Rakesh Sinha and Sri N P Shukla, learned counsels for the respondents.
Learned counsel for the petitioner has informed the Court that an identical issue as to whether the present writ petition is maintainable or not, against the Air Force School, Bamraulli, Allahabad, established by Indian Air Force Educational and Cultural Soceity, is already engaging the attention of the learned Division Bench in Special Appeal No. 3901 of 2012, wherein the Court has fixed 21.09.2012.
Sri Satish Mandhyan, learned counsel for the petitioner, fairly submits that as of now there are two conflicting judgments, one rendered in the case of Surender Vs. CBSE reported in 2006 (7) ADJ 322, wherein the learned Division Bench took the view that a writ petition is maintainable against the School, established by the aforesaid Society, whereas in a subsequent judgment of the Division Bench of this Court in the case of Union of India Vs. Dileep Kumkar Pandey in Special Appeal No. 1074 of 2010, a contrary view has been taken.
