Heard Sri Kalamuddin, learned counsel for the petitioner and Sri Girish Vishwakarma, learned Standing Counsel for the State.
Sri Kalamuddin submits that his Suit No. T201902030604348 (Gulabi Devi and others vs. State of U.P. and others) under Section 144 of the U.P. Revenue Code, 2006, Village Kathula Gauspur Pargana, Tehsil Sadar, District Prayagraj is pending since 07.05.2019 before the respondent no. 2-Upper U.P. Ziladhikari, Sadar, Tehsil Sadar, District Prayagraj.
In view of such facts, the writ petition can be disposed of with a direction to respondent no. 2-Upper U.P. Ziladhikari, Sadar, Tehsil Sadar, District Prayagraj to decide the aforesaid suit of the petitioner on its merits, if possible, within a period of 90 days from the date of receipt of computer generated copy of the order being passed today on PDF form strictly in accordance with law.
In above terms, the writ petition is disposed of.
It is made clear that this Court has not expressed any opinion on the merits of the case.
