Heard learned counsel for the applicant and learned A.G.A.
As per the prosecution case, several accused persons including the applicant assaulted the deceased; the weapon of assault assigned to the applicant is lathi; postmortem examination report supports the prosecution version; injury was caused by blunt object.
Learned counsel for the applicant submits that the co-accused Raj Karan and Tribhuvan Singh have already been enlarged on bail, hence the applicant is entitled to be released on bail.
Learned A.G.A. has vehemently opposed the prayer for bail and submits that the role of co-accused who have been enlarged on bail is distinguishable; applicant has been assigned the role of causing injury by blunt object which is supported by the postmortem examination report; it will not be in the public interest to release the applicant on bail.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Bhaiya Lal, involved in Case Crime No. 92 of 2017, under section 147, 452, 336, 304, 308, 504 I.P.C., P.S. Raipura, District Chitrakoot.
Accordingly, the bail application is rejected.
The trial court is directed to expedite the trial of the aforesaid case and conclude the same expeditiously on day to day basis from the date of production of a certified copy of this order, if, there is no legal impediment.
The Registrar General of this Court is directed to send a copy of this order to the learned trial court for compliance.
