Smt.Bhagyamma W/o late A Krishnappa, Aged about 45 years, R/at No.72, Andhanappa Nilaya, Thyagaraja Nagar, 1st Block, Bangalore-560028. Petitioner (By Sri. Jagan Mohan M.T. Advocate) And 1. Bangalore Development Authority, T.Chowdaiah Road, Kumara Park West, Bangalore-560020.
2. The Special Land Acquisition Officer Bangalore Development Authority, T.Chowdaiah Road, Kumarapark West, Bangalore-560020. Respondents (By Sri.S.Rajashekar, Advocate) This Writ Petition is filed under Articles 226 & 227 of Constitution of India, to direct the respondents to demark the un-acquired land of 6 acre 8 guntas in Sy.No.69/3, old Sy.No.69/2 of Kommagatta Village, Kengeri Hobli, Bangalore South Taluk, and prepare a sketch regarding the same as per representation dated 09.02.2015 vide Annexure-C and etc.
This Writ Petition coming on for ‘hearing’ this day, the Court made the following:-
ORDER In the instant petition, the petitioner sought for the following reliefs:
a. Issue a writ of mandamus or direction or order by directing the respondents to demark the un- acquired land of 6 acre 8 guntas in Sy.No.69/3, old Sy.No.69/2 of Kommagatta Village, Kengeri Hobli, Bangalore South Taluk, and to prepare a sketch regarding the same as per representation dated 09.02.2015 vide Annexure-C.
b. Issue any other writ or direction or order under the circumstances of the case which deems fit by this Court including cost of this writ petition.
2. There is inaction on the part of the concerned respondent in not considering the grievance of the petitioner relating to demark the un- acquired land in Sy.No.69/3 old Sy.No.69/2 at Kommagatta Village, Kengeri Hobli, Bangalore South Taluk and to prepare sketch pursuant to the petitioner’s representation dated 09.02.2015. It is more than four years, petitioner grievance is pending consideration before the respondents. Therefore, concerned respondent is hereby directed to pass a speaking order on the grievance of the petitioner within a period of four weeks from the date of receipt of this order and to communicate the decision to the petitioner at the earliest.
In the above terms, petition stands disposed of.
