THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER This writ petition is filed by the petitioner- Smt.Bhagyamma seeking writ of mandamus to direct respondent No.1-Special Tahsildar of Bangalore North Taluk to restore her name in the Revenue Records in respect of land bearing Sy.N0.106 measuring to an extent of 03 acres of Dasanapura village, Nelamangala Taluk, Bangalore Rural District, in pursuant to the order dated 04.02.2012 in Revision Petition No.310/2011-12 on the file of the 2nd respondent- Deputy Commissioner (revenue), Bangalore District. In the meanwhile, there is one more prayer to direct respondent No.3-Principal Secretary (Revenue), State of Karnataka, Bangalore, to initiate proceedings against respondent No.1-Special Tahsildar for non-compliance of the aforesaid order.
2. When this matter is taken up today, learned AGA would bring to the notice of this Court that the direction sought in favour of the respondent No.1 is already complied in registering the name of the petitioner-Smt.Bhagyamma W/o late Ramaiah as owner of the land bearing Sy.No.106 measuring to an extent of 03 acres of land situated in Dasanapura village, Nelamangala Taluk, Bangalore Rural District.
3. In that view of the matter, the first prayer does not survive for consideration. In so far as the second prayer is concerned, this Court is of the considered opinion in view of the first prayer being complied, question of issuing direction to respondent No.3 for initiating proceedings against respondent No.1 does not arise. Accordingly, the writ petition is rejected.
