Respondents (By Sri.Santhosh.S.Nagarale, Adv. for R-1, R-2 is served & unrepresented) This Writ Petition is filed under Articles 226 and 227 of the Constitution of India praying to direct R-1 to exclude the petitioner from the Visvesvaraya Technology University notification dated 06.04.2016 by new proclamation by directions of sanction through letter of accreditation by the said University validating the petitioner right to education within permissible limits (Annex-F Page No.23 issued by R-1) etc,.
This petition coming on for preliminary hearing in ‘B’ group this day, the Court made the following:
O R D E R The petitioner has challenged the portion of the Circular dated 6.4.2016 issued by the respondent (Annexure-F) to the Writ Petition. In pursuance to the interim order granted by this Court, the petitioner was permitted to appear and write examination in JAWA & J2EE, two subjects of 8th semester held on 3.1.2017, subject to the result of this Writ Petition.

Learned counsel appearing for respondent No.1 submits that pursuant to the notification dated 5.4.2017 issued by the respondent, the petitioner is entitled to the relief claimed in the Writ Petition. The respondent has notified that the students admitted to Under Graduate Courses in VTU prior to the academic year 2006-2007, who have completed the course in full and are not eligible for the award of degree due to backlog subjects are given three more consecutive attempts to complete their degree i.e., June/July 2017, December 2017/January 2018 and June/July 2018.
3. In view of the submissions made by the learned counsel for the respondent and as per the notification dated 5.4.2017 issued by the respondent, the petition has to succeed since the petitioner has appeared for the examination during January 2017. The respondent shall announce the results of the petitioner and if found unsuccessful, shall be entitled to two more attempts to clear the backlogs.
The Writ Petition stands disposed of in terms of the above.
