JUDGMENT / ORDER

These applications are preferred by accused Nos.2 to 5, in Crime No.35 of 2014 of the Kumbla Police Station for the offences punishable under Secs.143, 147, 148, 323, and 307 r/w Sec.149 of the Indian Penal Code, they apprehend arrest.
2. I have heard the learned Public Prosecutor and learned counsel for the petitioners. Learned Public Prosecutor has submitted that the earlier application preferred by the petitioners vide - B.A.No.860 of 2014 was rejected by this Court as per order dated 07.02.2014 holding that having regard to the nature of allegations and the role attributed to the petitioners, request for pre-arrest bail cannot be allowed.
3. I have gone through the said order. On hearing both sides, I do not find any change of circumstance to entertain these applications.
4. Learned counsel has requested that the petitioners may be allowed to surrender before the officer investigating the case.
5. Having regard to the relevant circumstances, I am inclined to allow that request.
B.A.Nos.2830 and 2920 of 2014 2 Resultantly the applications are disposed of as under:
(i) Petitioners shall surrender before the officer investigating Crime No.35 of 2014 of the Kumbla Police Station on 06.06.2014 at 10 a.m for interrogation.
(ii) In case interrogation is not completed that day, it is open to the officer concerned to direct presence of the petitioners on other day/days and time as may be specified by him which the petitioners shall comply.
(iii) In case the petitioners are arrested, they shall be produced before the jurisdictional magistrate on the date of arrest itself.
