Shri S.M.A. Abdy, learned counsel for appellant, is present.
In compliance with order dated 26.8.2019, District Judge, Bulandshahar has enclosed the explanation of judicial officer concerned with his letter dated 17.9.2019. The judicial officer in her explanation dated 14.9.2019 has submitted that she being more cautious and is vigilant as well as being in-charge of court concerned, verified the compromise separately in the manner earlier described. She has sought pardon vide letter of same date 14.9.2019. The judicial officer i.e. Civil Judge (Junior Division), Fast Track Court, Bulandshahar has also submitted that in compliance with order dated 16.9.2019 parties upon being duly identified by their respective counsel appeared before her on 16.9.2019 and verified the compromise deed dated 13.5.2017 by putting their signatures.
From the perusal of compromise deed, it is clear that averments made in letter of judicial officer are correct.
In the circumstances, the judicial officer concerned is pardoned with an advise to be careful in future. The appeal is decided and disposed of in terms of compromise dated dated 13.5.2017 which shall form part of decree.
Interim order, if any, stands vacated.
Let the lower court record be sent back to court below alongwith a copy of this judgment for necessary action, if any.
