Learned counsel for appellant and learned A.G.A. for the State are present.
Learned counsel for appellant informed that appellant Bhagwati Prasad has died.
Perused the office report dated 23.10.2021, wherein it is reported that as per report of Chief Judicial Magistrate, Basti, appellant has died.
Further perused the letter of Chief Judicial Magistrate, Basti dated 22.10.2021, wherein it is reported that appellant Bhagwati Prasad has died and he has recorded the statements of his family members and Serving Officer and has sent alongwith this file.
I have gone through the file and also perused the statements of witness Nirmal Gupta son of appellant Bhagwati Prasad, Nand Lal, Serving Officer L/Ct. Kanchan Yadav and the report of L/Ct. Kanchan Yadav, it is proved that appellant Bhagwati Prasad has died.
Accordingly, the appeal against appellant is dismissed as abated.
Since the appellant was on bail, his bail bond is cancelled and the sureties are discharged.
The lower court record be sent back to the concerned court forthwith.
