Heard learned counsel for the applicants and learned A.G.A. for the State.
This application under Section 482, Cr.P.C. has been filed for quashing the non-bailable warrants dated 13.09.2018 passed in Case Crime No. 228 of 2017, under Sections 147, 148, 307, 452, 323, 504 I.P.C., PS-Madarak, District-Aligarh by the Judicial Magistrate, Court No.2, Aligarh.
After having heard the learned counsel for the applicants and perused the material brought on record, I do not find any justification for quashing the impugned order in the aforesaid case. The prayer for quashing the same is hereby refused.
However, for a period of 15 days from today, the non-bailable warrants issued against the applicants shall be kept in abeyance. In the meanwhile, applicants may surrender before the Court below and apply for bail.
In case, the applicants do not appear before the court below within the aforesaid period, coercive action shall be taken against them.
It is made clear that the applicants will not be granted any further time by this Court for surrendering before the Court below as directed above.
With the aforesaid directions, this application is finally disposed of.
