This application u/s 482 Cr.P.C. has been filed seeking the quashing of order dated 02.03.2019 passed by Additional District & Session Judge/ F.T.C.-II, Siddhartha Nagar as well as the entire proceedings of Criminal Case No.479 of 2012 (Kusum Vs. Bhagwandeen), under sections 125 Cr.P.C. and also to stay the proceedings of Criminal Case No.25 of 2019, under section 128 Cr.P.C., Police Station- Khesraha, District- Siddhartha Nagar, pending in the Court of Principal Judge, Family Court, Naugarh, Siddharth Nagar.
Heard applicant's counsel and learned AGA. Entire record has been perused.
Counsel has not been able to point out any illegality, impropriety or incorrectness, much less than any abuse of court's process which may persuade this Court to interfere in the impugned order. By the impugned order only Rs.2,000/- per month has been awarded to the wife/opposite party no.2 as a matter of maintenance which in the present days of high price rise cannot be said to be either excessive or disproportionate in fact, it appears to be on the lower side. The facts and circumstances of the case have been gone into by the Court below and there is no good reason to interfere in the same.
The application lacks merit and stands dismissed.
