(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present application has been preferred by the applicant - accused for temporary bail on the ground that he wants to attend marriage of his own daughter, which is fixed on 29.1.2012.
Pursuant to the earlier order passed by this Court, the learned APP, based on the report received by him from the Police Inspector, Dholka Police Station, states that the marriage is fixed. Hence, the ground appears to be genuine. The jail report shows that whenever the convict was released on temporary bail, he had surrendered in time.
Under these circumstances, the applicant - convict be released on temporary bail for a period of two weeks from the date of his actual release on condition of furnishing a personal bond of Rs.5,000/- with a surety of like amount with the further direction that the applicant - convict shall surrender before the concerned jail authority on expiry of the temporary bail period.
The application is allowed to the aforesaid extent. Rule made absolute accordingly. Direct service is permitted.
