Petitioner is aggrieved by an order of transfer dated 22.6.2018, whereby he has been transferred on administrative ground from Bareilly to Kanpur.
The order is challenged on the ground that petitioner holds a district level post and is office bearer of the union.
While entertaining the writ petition, time was allowed to learned Standing Counsel to obtain instructions. According to instructions, copy of whereof has been furnished to the Court, it appears that petitioner holds a state level post and has previously been transferred from Bahraich to Bareilly. It is also stated that there is no vehicle available at Bareilly for which petitioner could be engaged as driver. Submission is that as there is no vehicle available at Bareilly, therefore, he has been transferred.
In view of the fact that petitioner holds a transferable post and that petitioner has continued at the same station since 2009, no interference with the order of transfer is called for.
Writ petition is, accordingly, dismissed.
