Heard learned counsel for the petitioner and learned Standing Counsel.
This writ petition is filed against the order of the District Magistrate cancelling the fire arm licence of the petitioner.
Admittedly, two criminal cases, one under Section 307 IPC being Case Crime No.236 of 2012 and another under Sections 302, 307, 147, 336 of IPC being Case Crime No.104 of 2011 are registered against the petitioner.
The claim of the petitioner before the authority below was that on the date of alleged incident the fire arm of the petitioner was deposited at the fire arm shop.
Facts of the case are considered by the District Magistrate and thereafter the District Magistrate has recorded his substantive satisfaction and cancelled the fire arm licence of the petitioner.
Against the order of the cancellation of fire arm licence, the appeal was filed before the Divisional Commissioner, Aligarh. The Divisional Commissioner, Aligarh vide the order dated 22.02.2019 has affirmed the order passed by the District Magistrate, Etah.
I have perused the orders passed by the District Magistrate, Etah and the order passed by the Divisional Commissioner, Aligarh, I find no ground to interfere in the matter. The orders passed by the D.M. and Divisional Commissioner are fully justified and are passed after consideration of the facts of the case.
The writ petition is dismissed.
