By means of this writ petition the petitioner has come to this Court praying that disciplinary proceeding be initiated against respondent no. 5 who is Lekhpal.
It is to be noted that an order has been passed that the petitioner has encroached upon Gaon Sabha land.
It is claimed by the petitioner that the petitioner had moved an application for measurement and demarcation of his land, but do so, the respondent no. 5 in the capacity of the Lekhpal demanded illegal gratification which was not satisfied by the petitioner and, therefore, an order under Section 67 of the U.P. Revenue Code, 2006 has been passed.
That being the case, proceeding under Section 67 of the U.P. Revenue Code, 2006 has been initiated, the petitioner is to participate in the proceeding and to put forward his claim. In writ proceeding such a direction cannot be issued.
With the aforesaid observation, the writ petition is disposed of.
