This application has been filed with a prayer for quash the order dated 25.2.2010 passed by learned A.C.J.M. Curt No. 10, Faizabad.

From the perusal of the record it appears that application under sexton 216 Cr.P.C. has been allowed and accused persons have been summoned to face the trial for the offence under section 307 IPC. The learned Magistrate concerned has not committed any error in taking the cognizance because the material collected by the I.O. was disclosing the offence under section 307 IPC, therefore, the prayer for quashing the same is refused.

Accordingly this application is dismissed.
