JUDGMENT / ORDER

Heard Mr. Parmar, learned counsel for the petitioner and and Mr. J.K. Shah, learned counsel for the respondents.
Prima-facie, the petitioner was given more than three chances to clear the examination and therefore, his services were terminated. The Resolution dated 30.03.1989 relied upon by the petitioner only enables the Secretary to exercise his discretion, which has not been exercised by him.
Counsel for the respondent relied upon the decision of Supreme Court 1995 6 JT SC 101.
