By way of present application, filed under Section 389 of the Code of Criminal Procedure, 1973, the applicant has prayed for suspension of conviction pending the criminal appeal.
Heard Mr.R.Z. Shaikh, learned counsel for the applicant, Mr.Y.N. Ravani, learned counsel for the respondent No.1 and Mr.H.L. Jani, learned Additional Public Prosecutor for respondent No.2-State.
Mr.Shakih, learned counsel for the applicant, stated at the bar that by mistake order of granting bail by the lower Court is not produced on record of this case. The applicant is granted bail by the trial Court upto 13th April, 2012. He has further contended that fine amount is already paid. He, therefore, contended that bail period of the applicant be extended and till the time he will produce on record copy of order of granting bail by the trial Court as well as copy of receipt showing payment of fine.
Hence, in view of statement made by Mr.Shaikh, learned counsel for the applicant, bail granted by the trial Court is hereby extended till 18th April, 2012 and in the meanwhile learned counsel for the applicant is directed to produce on record copy of order granting bail by the trial Court as well as copy of receipt showing payment of fine. The matter is adjourned to 17th April, 2012.
