In view of the order proposed to be passed, notices need not go to the private respondents.
The petitioner has preferred present petition under Article 227 of the Constitution of India inter-alia with the prayer to direct the court below i.e. Civil Judge (Senior Division), Jhansi to decide the (6C) application dated 11.11.2020 of the petitioner/plaintiff in Original Suit No.485 of 2020 (Bhagirathi Raikwar Vs. Ram Lal and others) within stipulated period with further prayer to restrain the defendants not to interfere in the peaceful possession of the petitioner over the land in question pursuant to the registered sale-deed dated 23.09.2020.
In the facts and circumstances of the case, the Court is of the opinion that the interim injunction application filed by the petitioner before the Civil Judge (Senior Division), Jhansi being (6C) application dated 11.11.2020 supported with affidavit be decided.
In view of the same, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the court below to consider and decide the aforesaid (6C) application dated 11.11.2020 in accordance with law on the next date fixed in the matter after hearing all the parties concerned. If on account of any reason no orders were passed on the aforesaid date, the decision will be taken on the aforesaid application preferably within a period of two months, thereafter.
